U.S. citizens may enter into marriage in Austria. The procedure is, however, somewhat complex. For this reason, U.S. citizens contemplating marriage in Austria should thouroughly prepare all required documents. If you plan to get married in Austria, you will need a Marriage Affidavit/Certificate of No Impediment. It may be executed before a notary public in the United States (in this case it will require a Hague apostille) or Marriage Affidavit/Certificate of No Impediment (external link, U.S. Embassy in Austria) executed before a Consular Officer of the U.S. Embassy in Vienna.

Certificate of No Impediment for Austria
Marriage Affidavit/Certificate of No Impediment (pdf file, free download): Sign, and have your signature notarized by a notary public. If you sign in the United States, your document will be valid in Austria only if it is further legalized by a Hague apostille. An apostille needs to be from the state where the notary public is qualified.
You can also make an appointement in the U.S. embassy in Vienna and sign the Marriage Affidavit/Certificate of No Impediment (external link, U.S. Embassy in Austria) before a Consular Officer. In case of a divorce, in which the woman’s or the man’s nationality are different or which took place outside of their home country, the permission of the Austrian Ministry of Justice is required, which will delay the procedure.
